Before starting the processing of a patent is very important to review the published literature on it, with the aim is to gather useful information about the state of the art of that specific technology.

The resources for doing so are varied:

  • Informal information sources: attending trade fairs, events, conferences, intoaccount, conversations, etc. This early information is vital for the generation of knowledge about the inner workings of any organization.
  • Formal information sources: databases of patents and prior art.

The combination of both sources allows the organization to know the market situation, identify competitors and other threats (such as potential alternative technologies), and studies of patentability or proofs of concept to define the starting point of our technology.

In search of information, the recommended steps to follow are:

  1. Read description of the researcher. The intention is to collect features and technical details that describe the invention and will produce more valuable and accurate documents.
  2. Define technical characteristics and technical effects to search divided. Segmenting the concept of the invention allows different subtopics related searches from concept to protect.
  3. Get key words in English. Once the technical description of the invention, the next stage is to extract keywords that allow us to build the search. It recomdable always check with the researchers the choice of these keywords to be as accurate as possible.
  4. Search Databases (BD) in combination. From the key words in English we proceed to develop the first search that will serve both as a source of feedback concepts that can improve the extraction of more relevant documents relation to the invention treaty. To do this, follow these guidelines:
    • Start your search with the Derwent BD
    • Extending the results obtained with the other BD
    • Consult other sources such as scientific articles and the Internet.
  5. To compare the results and generate the state of the art

With all this information we are ready to work with patent seekers. The main ones are:

  • Intellectual Property Offices by country: Directory
  • Patent Law: The Collection of Laws for Electronic Access provides easy access to intellectual property legislation from a wide range of countries and regions, as well as intellectual property treaties administered by WIPO.
  • Electronic databases: the national or regional offices of patents usually have computerized databases that can sconsultarse free on the Internet. WIPO also provides access to a comprehensive electronic database on international patent applications filed in the PCT system.
  • Advice: Area Patent Information WIPO offers free services to users in developing countries seeking technical search results related to their inventions.
  • Other resources: Intellectual Property Digital Library WIPO
